Revision and Release of the Catalogue of Technologies Prohibited or Restricted from Exporting in China

On December 21st, the Ministry of Commerce, together with the Ministry of Science and Technology, revised and released the "Catalogue of Technologies Prohibited and Restricted from Exporting in China". The number of technical items has been compressed from 164 to 134, with a total of 34 items deleted, 4 new items added, and 37 modifications made.
The person in charge of the Service and Trade Department of the Ministry of Commerce introduced that in accordance with the Foreign Trade Law of the People's Republic of China and the Regulations on the Administration of Technology Import and Export of the People's Republic of China, the Ministry of Commerce, together with the Ministry of Science and Technology, has formulated, adjusted, and published a list of prohibited and restricted export technologies to standardize technology export management, maintain technology export order, promote foreign economic and technological cooperation, and safeguard national economic and technological rights and interests. The catalog was adjusted twice in 2008 and 2020. This revision is a routine adjustment made to the catalog in accordance with the changing technological development situation and the needs of technology trade management in accordance with the law. The revision of this catalog has fully solicited opinions from relevant departments, industry associations, academia, and the general public.
One is to remove six prohibited export technology items, including green plant production regulator manufacturing technology, as well as 28 restricted export technology items, including medical diagnostic devices and equipment manufacturing technology, target feature extraction and recognition technology.
The second is to add one prohibited technology entry, which is used for human cell cloning and gene editing technology. Three restricted export technologies, including hybrid advantage utilization technology for crops, bulk material loading and unloading and transportation technology, and LiDAR system, have been added. Business entities may apply for export in accordance with the licensing procedures in accordance with the law.

The third is to adjust the control points and technical parameters of 37 technical items, involving 6 prohibited export technical items such as traditional Chinese medicine resources and production, as well as 31 restricted export technical items such as economic crop cultivation and breeding technology, non-ferrous metal metallurgy technology, and large-scale high-speed wind tunnel design and construction technology.

The person in charge stated that according to the Regulations of the People's Republic of China on the Administration of Technology Import and Export, technology export refers to the act of transferring technology from within China to overseas through trade, investment, or economic and technological cooperation. Technologies that are prohibited from export in the catalog shall not be exported. Technologies subject to export restrictions shall be subject to license management; Export is not allowed without permission. Technologies that belong to free export are subject to contract registration management. The operating entity shall comply with the catalog and fulfill relevant procedures such as export licensing and contract registration in accordance with the Regulations of the People's Republic of China on the Administration of Technology Import and Export, the Measures for the Administration of Technology Prohibitions and Restrictions on Export, and the Measures for the Administration of Technology Import and Export Contract Registration.
