The reporter recently learned from the regular press conference of CCPIT in April that since its launch in December 2020, the CCPIT enterprise cross-border trade and investment legal comprehensive support platform (hereinafter referred to as "Trade Law link") has provided legal consulting services for enterprises in 7 * 24 hours, with a total of 2.15 million website views and 236000 legal consulting services for enterprises across the country. The consulting and answering results have been thanked and affirmed by many enterprises.
According to the statistics of the platform, enterprise consulting problems mainly involve five categories, of which the conflict between Russia and Ukraine is the most hot topic of recent enterprises.
According to the consultation of TradeLaw, enterprise consultation problems mainly involve five categories: international trade, international compliance, cross-border investment, dispute settlement and intellectual property rights, accounting for more than 95% of the total consultation. International trade issues account for about 43% of enterprise consultation, mainly involving RCEP, two anti one guarantee, import and export policy requirements and other issues. International compliance issues account for about 20% of enterprise consultation, including more consultation on project management, employment system and sanctions response. Establishing and improving overseas compliance system has gradually become the focus of cross-border trade and investment enterprises. About 14% of the enterprise consultation involves issues related to cross-border investment, such as investment and plant construction, enterprise establishment processes and requirements, such as the types of foreign investment restricted by the target country, preferential policies for overseas companies, relevant requirements for the establishment of overseas warehouses, etc. Dispute settlement issues account for about 13% of enterprise consulting, mainly focusing on the agreement of dispute settlement clauses in international trade contracts, the selection of arbitration institutions and the recovery of payment caused by the obstruction of international cargo transportation. Intellectual property issues account for about 5% of enterprise consultation, mainly involving trademark, technology and other intellectual property disputes, professional judgment of patent infringement, etc. Among them, small and medium-sized cross-border e-commerce export enterprises encounter malicious prosecution of intellectual property infringement and other cases by foreign peer companies, showing an increasing trend.
The recent conflict between Russia and Ukraine has had a great impact on the global economy. Enterprises pay great attention to the performance of relevant international trade. Some enterprises report that individual enterprises in some countries reject goods, delay payment or cancel contracts by citing force majeure clauses, facing the risk of two-way force majeure default.
