Zhang Mingqi, Vice President of the China Law Society, put forward expectations and suggestions for the "the Belt and Road" rule of law research in his speech: seek a more proactive opening strategy, and build the "the Belt and Road" into a popular international public product and international cooperation platform; Promote the wide dissemination of the research results on the rule of law of the "the Belt and Road" to the world; Experts and scholars should continue to make new progress in the study of the rule of law of the "the Belt and Road" with solid and rigorous research work.
Huang Jin, President of the Chinese Society of International Law, analyzed the path of innovating and improving the international economic and trade rules of the "the Belt and Road". He said that the "the Belt and Road" international economic and trade rules are a complex system, and its innovation and improvement paths are diverse. In this regard, he put forward five suggestions: First, we should fully recognize the problems and obstacles in the integration and construction of rules; Second, the construction of rules requires comprehensive measures and joint efforts; The third is to coordinate the domestic economic and trade legal rules with the "the Belt and Road" international economic and trade rules; Fourth, innovate and improve bilateral investment agreements, free trade agreements and tax treaties on the basis of equality and mutual benefit; Fifth, adhere to inclusive and sustainable development.
Shen Sibao, President of the International Economic Law Research Association of the China Law Society, stressed that the "the Belt and Road" is an international public product and international cooperation platform, which needs to be jointly built and shared by the international community. On the issue of co building the rule of law, Shen Sibao suggested that under the condition of abiding by existing international rules, we should reform outdated rules and establish widely accepted new rules; Encourage the countries along the "the Belt and Road" to improve the process and quality of rule of law construction with the stories and experience of China's comprehensive rule of law and promoting rule of law construction; Advocate the spirit of contract and freedom of contract in the construction of rule of law; We should better identify and attract talents, so that talents can play a real role.
Zhao Hong, former chairman of the WTO Appellate Body and professor of the Peking University School of Law, believes that the complex and changing background of today's era poses a huge challenge to how international economic and trade rules evolve. The "the Belt and Road" initiative is not only an important place for China to develop and practice international law, but also an important platform for foreign exchanges and cooperation. The "the Belt and Road" needs to move towards the rule of law and institutionalization. It is necessary to regularize and legalize the practices of China and the "the Belt and Road" countries in trade, investment, intellectual property, finance, taxation, sustainable development, and digital rules, promote the establishment of international institutions and organizations, and address issues of common concern.
He Fan, Deputy Director of the International Cooperation Bureau of the Supreme People's Court, introduced several important work carried out by the court system in combination with the practice of the people's court to jointly build the "the Belt and Road" with high quality services: first, do a good job of the duties and strengthen the construction of foreign-related judicial mechanism; Second, we should do a good job of opening and bridging the road, and create an advantageous platform for judicial assistance; Third, do a good job of icing on the cake and promote the international dissemination of the effectiveness of the rule of law. At the same time, He Fan also put forward four groups of issues to be studied jointly by the theoretical and practical circles: to cooperate with the reform of the trial level function orientation of the Supreme People's Court, to study how to effectively refine the legal application of foreign-related cases, and to promote the Supreme Judicial Organ to better play its role in unifying the foreign-related rule of law; Cooperate with the amendment of the Civil Procedure Law on expanding the scope of judicial confirmation, study and formulate supporting laws such as the Commercial Mediation Law, and improve the procedures for the establishment of mediation organizations, the cultivation model and the main body of supervision; In combination with the universal application of online litigation in the international judicial field, study the issues of judicial sovereignty and judicial assistance involved in online video evidence collection, evidence disclosure and transnational trials; In combination with the revision of the foreign-related part of the Civil Procedure Law, we should study frontier legal issues such as jurisdiction without connection points, injunctions, parallel litigation, and sovereign immunity.
